3. Pre-Opening and Website Signups

Before or after a store opens, The Vibe may allow customers to register for an opening list, first-access list, email list, loyalty program, promotional offer, or other marketing program.

Information submitted through our website may be collected for internal marketing, attribution, operational, or administrative purposes.

Where appropriate, consenting subscriber information may also be added to Toast Marketing so that The Vibe can manage and send customer communications.


4. Job Applications and Employees

This section describes how The Vibe collects, uses, and maintains personal information from individuals who apply for employment with us and individuals we employ. It applies in addition to the other provisions of this Privacy Policy. Where this section and another section conflict regarding applicant or employee information, this section governs.

Information We Collect From Applicants

When you apply for a position with The Vibe, we may collect:

  • First and last name

  • Email address

  • Mobile phone number

  • Responses to application screening and experience questions

  • Stated availability to work

  • A résumé or similar document, if you choose to provide one

  • Confirmation that you are at least 18 years of age

  • Interview scheduling information, including the time slot you select

  • Evaluations recorded by hiring managers during or after an interview, including ratings and written notes

  • The status and outcome of your application

We do not collect your date of birth through our standard employment application.

Information We Collect From Employees

If you are hired, we may additionally collect and maintain:

  • A copy or photograph of your food handler certification

  • Your acknowledgement of our employee handbook, including the date, time, and IP address associated with the acknowledgement

  • Wage rate, start date, and employment status

  • Ongoing work availability

  • Time-off requests and any reason you voluntarily provide with a request

  • Training completion and sign-off records

  • Scheduling, shift, timekeeping, and other operational records associated with your employment

How We Use Applicant and Employee Information

We may use applicant and employee information to:

  • Evaluate employment applications

  • Communicate with applicants about their application

  • Schedule and conduct interviews

  • Verify certifications required for food-service work

Applicant and employee information collected through our employment systems is not used to enroll individuals in The Vibe's customer marketing programs solely because they applied for or accepted employment.

  • Google Cloud Platform and Firebase for hosting, data storage, file storage, and operation of our hiring and internal operations systems

  • SendGrid for delivery of emails relating to applications, interviews, onboarding, or employment

  • Google Workspace, including Google Meet, for business communications, interview scheduling, and video interviews where applicable

  • Toast for certain employee, timekeeping, payroll, and restaurant-operation functions

  • Twilio for text messaging or communications where applicable

These providers process information in accordance with their respective services and privacy practices.

When you access certain portions of our website or employment application, your browser may also request fonts or other display resources from Google-operated servers, including fonts.gstatic.com or gstatic.com. Those requests may transmit technical information such as your IP address.

Food Handler Certification Images

Employees may be asked to upload a photograph or scanned copy of a food handler certification so that The Vibe can verify the certification and maintain required certification information.

We ask employees to submit an image showing the certificate only.

The Vibe may update the way certification information is processed as our systems and operations change. Any material changes to our processing practices may be reflected in an updated version of this Privacy Policy.

Interview Evaluations

Interview evaluations, ratings, and hiring-manager notes are maintained for internal hiring and management purposes and are not made available to applicants through our application website.

Retention of Applicant and Employee Information

We retain applicant and employee information for as long as reasonably necessary for the purposes for which it was collected, to administer our employment relationship, maintain appropriate business and employment records, resolve disputes, and comply with applicable legal obligations.

Certain employment records may need to be retained even after an employment relationship ends or following a privacy request where retention is required or permitted by law.

Our retention practices may vary depending on the type of information, the individual's relationship with The Vibe, and applicable legal requirements.

Applicant and Employee Privacy Requests

Applicants and employees may contact The Vibe regarding personal information maintained about them.

Depending on the nature of the information, the individual's relationship with The Vibe, and applicable law, certain information may be eligible for access, correction, or deletion. Some information may be retained where necessary to satisfy legal, employment, record keeping, security, or other legitimate business obligations.

Submitting a privacy request does not guarantee that all information associated with an applicant or employee can or will be deleted.

If you choose to receive marketing emails from The Vibe, we may send communications including:

18. The Vibe OS Mobile App

The Vibe OS is our internal mobile app for employees of The Vibe. It is not available to the public and it has no public sign-up — accounts are created by a store manager.

What the app collects. When you use the app we process your name and email address, your employment information with us — including your schedule, shifts, onboarding progress and pay rate — and any photos you choose to take or upload in the app, such as a completed task, waste, a delivery invoice or a certification like a food handler card.

Notifications. If you turn on notifications, we store a notification token for your device together with the device platform, so we can tell you when something about your schedule changes. You can turn notifications off at any time in your device settings, and signing out removes the token for that device.

Who we share it with. We use Google Firebase to host the app's data, authenticate sign-in and deliver notifications, and Toast to keep employee records in step with our point of sale. We do not sell your information, we do not use it for advertising, and the app does not collect your location.

Your choices. You can ask us what we hold about you, ask us to correct it, or ask us to delete it, by writing to support@drinkthevibe.com or to The Vibe, 713 Hebron Parkway, Suite 290, Lewisville, Texas.
